What Black Lotus Customers Should Know

Texas laws and regulations surrounding hemp-derived products, cannabinoids, vaping, and other alternative products continue to change.

At Black Lotus, we believe customers deserve clear information—not rumors, social-media speculation, or confusing legal jargon.

This page is our ongoing Texas Product Update Center. When an important rule changes that may affect products sold in our store, we will update this page.

CURRENT TEXAS STATUS

🟢 HEMP-DERIVED DELTA-9

Compliant consumable hemp products may currently contain Delta-9 THC when they meet Texas requirements, including the applicable THC concentration limit, testing, labeling, and other regulatory requirements.

Texas currently limits consumable hemp products to no more than 0.3% total Delta-9 THC on a dry-weight basis.

Black Lotus Status: Available only when products meet our current compliance and testing requirements.

🔴 DELTA-8 THC

Texas DSHS currently considers Delta-8 THC a controlled substance.

DSHS states that only naturally occurring trace amounts of Delta-8 from the hemp plant used to manufacture a consumable hemp product are permissible.

The Texas scheduling action affecting Delta-8 became effective July 31, 2026.

Products labeled as containing Delta-8—or products found to contain more than permissible trace amounts—may be subject to detention and referral to law enforcement.

Black Lotus Status: We do not currently treat Delta-8 products as a permissible retail category.

🔴 / 🟡 THCA

Texas rules changed significantly regarding THCA.

Effective March 31, 2026, Texas DSHS rules include tetrahydrocannabinolic acid, commonly called THCA, when determining total Delta-9 THC and the acceptable hemp THC level.

That means a product should not automatically be considered Texas-compliant simply because it is marketed or labeled as “THCA.”

The actual laboratory results and total THC calculations matter.

Black Lotus Status: Products marketed as THCA are reviewed under the current total Delta-9 THC rules rather than based solely on the product name or packaging.

🔴 CANNABINOID VAPES

Texas law prohibits the marketing, advertising, sale, or offering for sale of e-cigarette products that contain or are mixed with cannabinoids.

These restrictions took effect September 1, 2025 under Senate Bill 2024.

The law applies to e-cigarette products regardless of whether they contain nicotine.

Black Lotus Status: We do not treat cannabinoid vape products as a currently permissible Texas retail category.

🔞 CONSUMABLE HEMP AGE REQUIREMENT

Texas requires customers purchasing consumable hemp products to be 21 years of age or older.

Retailers are also required to verify age using valid government-issued identification before the purchase.

At Black Lotus, ID verification is required.

WHAT CHANGED WITH DELTA-8?

One of the biggest recent Texas changes involves Delta-8 THC.

The Texas Department of State Health Services states that the Texas scheduling action affecting Delta-8 became effective July 31, 2026.

DSHS currently states that Delta-8 THC is a controlled substance and that only naturally occurring trace amounts from the hemp plant used to manufacture the product are permissible.

This is important because older articles, websites, product packaging, and social-media posts may still describe Delta-8 as though nothing has changed.

That information may now be outdated.

At Black Lotus, we would rather remove a questionable product than continue selling it simply because another retailer still has it on the shelf.

WHAT ABOUT DELTA-9?

Delta-9 is different from Delta-8 under Texas's current consumable hemp framework.

Texas DSHS states that consumable hemp products may contain Delta-9 THC at a concentration of no more than 0.3% on a dry-weight basis, subject to the state's other testing, labeling, manufacturing, registration, and product requirements.

This is why compliant hemp-derived Delta-9 products can still exist in Texas even as the rules surrounding other cannabinoids have changed.

However, the words “hemp-derived” alone do not automatically make a product compliant.

The laboratory results, formulation, labeling, manufacturer, and applicable Texas requirements still matter.

WHAT HAPPENED TO THCA?

THCA has been one of the most confusing areas for Texas consumers.

For years, many products were marketed around a distinction between THCA and Delta-9 THC.

Texas's 2026 consumable hemp rules changed how that calculation is handled.

The adopted rules include THCA in the definition and calculation of total Delta-9 THC and the acceptable hemp THC level.

For customers, the easiest way to understand this is:

The name printed on the package does not determine whether a product meets Texas requirements.

Actual laboratory testing does.

That is why Black Lotus evaluates current products differently than we may have evaluated products under previous rules.

WHAT ABOUT THC AND CANNABINOID VAPES?

Texas also made major changes to e-cigarette products.

Senate Bill 2024 became effective September 1, 2025 and prohibits certain e-cigarette products from being marketed, advertised, offered for sale, or sold in Texas.

Among other restrictions, the law prohibits e-cigarette products containing or mixed with:

• Cannabinoids

• Kratom

• Kava

• Mushrooms

• Tianeptine

• Alcohol

• Derivatives of those substances

The law also created additional restrictions involving certain product designs, marketing, and where certain e-cigarette products are manufactured.

These rules are separate from Texas's consumable hemp rules covering products such as compliant gummies, beverages, and other non-vape products.

WHY DOES BLACK LOTUS SOMETIMES REMOVE PRODUCTS SO QUICKLY?

You may occasionally walk into Black Lotus and notice that a product—or even an entire product category—is suddenly gone.

There is usually a reason.

Regulations in these industries can change quickly.

When credible new regulatory information affects a product, we review:

• Texas DSHS guidance

• Current Texas laws and regulations

• Certificates of Analysis

• Cannabinoid concentrations

• Product ingredients

• Manufacturer information

• Product labeling

• Testing documentation

• Regulatory and enforcement updates

If we are not comfortable with a product's current status, we may remove it rather than gamble with our customers or our business.

Another store continuing to sell a product does not necessarily mean that product meets current Texas requirements.

Our goal is not to have the biggest possible shelf.

Our goal is to have a shelf we understand.

WHY LAB RESULTS MATTER

One of the most important tools we use when evaluating hemp-derived products is the Certificate of Analysis, commonly called a COA.

A COA can provide information such as:

• Cannabinoid concentrations

• Delta-9 THC levels

• Total THC

• Batch information

• Laboratory information

• Testing date

• Product identification

• Additional safety testing when performed

Texas labeling requirements also require certain consumable hemp product information and access to applicable COA information.

Packaging and marketing can make almost anything sound impressive.

The lab report tells us considerably more.

That's one reason Black Lotus maintains a dedicated Lab Results section on our website.

WHY BLACK LOTUS TAKES COMPLIANCE SERIOUSLY

We built Black Lotus around product knowledge and customer service.

That means sometimes telling customers something they may not want to hear.

Sometimes a product customers love disappears.

Sometimes an entire category changes.

Sometimes the answer today is different from the answer six months ago.

We don't control Texas law.

We do control how responsibly we react to it.

Our commitment is to continue reviewing the products we carry and adapting as the regulatory environment changes.

DON'T RELY ON OLD INFORMATION

One of the biggest problems in this industry is outdated information.

An article from last year may still rank on Google.

A manufacturer may still have an old product description online.

A social-media video may have millions of views.

A Reddit post may sound convincing.

A product may even still be sitting on another store's shelf.

None of those things necessarily tell you what Texas's current requirements are.

Whenever possible, Black Lotus relies on current information from official agencies and regulatory sources.
